Parking Rental Agreement

Terms & Conditions

1. Payments can be made via the website: www.rigspotparking.com or a valid Credit card is required to be on file for payment. Payment is due on the 1st of every month; after the 3rd of the month, a $5 fee will be added on to any outstanding balance daily.  Contract will be terminated and parking privileges will be revoked if payment along with fees are not received on the 10th day.  After 10 days, your vehicle will be towed at owner's expense.
2. No unauthorized: mechanical service, truck wash, and other services performed by any non authorized repairs person will be allowed without permission.
3. Personal mechanical maintenance is allowed at your own risk.  Any spillage caused by personal maintenance will be the tenant's sole responsibility to clean up at their own expense in an approved manner set forth by the City of Houston; or Rig Spot Parking will hire an approved spill clean up company and the tenant will have a charge back for cleaning expenses.
4. No dumping of oil, antifreeze, or any other environmental contaminant product spills will be tolerated.  Any used oil/fuel filters/antifreeze can be disposed of properly at any local Autozone or O'reilly's.  We are obligated to report harmful environmental spills to the City of Houston which will result in the filing of a claim against your company insurance**.
5. Please treat the parking space rented as you would your home. Trash should be disposed of properly in the provided dumpster located on the property.  The dumpster is for TRASH ONLY!! DO NOT throw tires, truck parts, used fuel filters, used oil containers, or used antifreeze containers into the trash dumpster as they are NOT allowed with household trash.  The dumpster will not be collected by the hired waste management company, who may enforce a fine if the aforementioned rules are not followed.
6. Fuel transfer is not permitted on site as it may lead to a spill**. 
7. Please DO NOT discard damaged tires on property, a $50 disposal fee will be applied to every tire left on the ground.
8. Parking lot speed limit is 10 mph.  Please follow the speed limit for safety.  Reckless driving will result in the termination of the parking agreement.
9. Always leave your personal car in your designated parking spot.
10. NO ALCOHOLIC BEVERAGES PERMITTED on the property.
11. 2 weeks notice of rental space termination is required.
12. Parking lot is equipped with security cameras and automatic gate only, no 24 hr on duty security guard is available.  Park at your own risk.
13. You are required to have insurance coverage for your equipment, personal injury and liability. We take every possible precaution to protect your equipment, but we are not responsible for any loss or personal injury that may occur or have occurred on the premises.

Release of Liability

1. I hereby release Rig Spot Parking, LLC., of any responsibility or liability for loss and/or damages to my equipment/vehicle, including but not limited to partial or total theft, collision, fire, construction, weather or any Acts of God et al. during my parking space rental on the rental premises.
2. I understand that if my equipment/vehicle needs to be removed from the premises and/or moved to another spot within the premises, I will be responsible for any charges incurred.
3. I understand and agree that neither Rig SPot Parking, LLC., nor its affiliate companies, employees, trustees, directors, members, officers, directors, representatives, instructors, instructors, or agents may be held liable in any way for any injury, harm, or other damages as a result of parking on the property.
4. I hereby release and forever discharge Rig Spot Parking, LLC., from any claim whatsoever which arises or may hereafter arise because of first-aid treatment or other medical services rendered in connection with an emergency during my tenure as a tenant.
5. I understand that using the services provided by Rig Spot Parking, LLC., may include activities that may be hazardous.  As a tenant, I hereby expressly assume risk of injury or harm from these activities and release Rig Spot Parking, LLC. from all liability.
6. I understand that equipment/vehicle(s) parked in violation of this agreement or out of assigned parking, are subject to booting or towing.  I further understand that violation of the parking agreement may result in the termination of the parking agreement.
7. I represent to Rig Spot Parking, LLC., that:
   1. I have read this release of liability agreement and fully understand its contents and the effect of its terms and provisions,
   2. I, by renting a parking spot, agree to the release of liability at my own free act and deed.
   3. With respect to the matters set forth in this release of liability; no oral representations, statements, or inducements other that those expressly contained herein have been made to me by any of the releases, and
   4. I am over eighteen (18) years of age and fully competent to sign this release of liability, and
   5. I execute this release for complete and adequate consideration, fully intending to be bound by the same.
8. I agree that this release of liability shall be constructed in accordance with the laws of the State of Texas.
9. If any term or provision for this release of liability shall be held illegal, unenforceable, or in conflict with any laws governing this release, then I agree that the validity of all remaining terms and provisions shall not be affected thereby.
